Terms of Service

These terms are an agreement between you and BookZefy. By creating an account, booking through a BookZefy page or otherwise using the service, you agree to them.

The service

BookZefy provides online booking software for freelancers and independent professionals (“Pros”): a booking page, scheduling, deposit collection and reminders. People who book with a Pro are “Clients”. We may add, change or remove features over time. Some features and plans may not be available yet while we roll the service out.

Accounts

  • You must be at least 18 and able to enter into a contract.
  • Give accurate information and keep your login secure. You are responsible for activity under your account.
  • One account per Pro unless your plan includes team members.

Plans and billing

  • Plans are billed monthly in US dollars at the price shown on our pricing page when you subscribe. There is no contract: you can cancel at any time and your plan stays active until the end of the paid period.
  • BookZefy charges a flat monthly fee and does not take a commission on your bookings. Standard payment processing fees charged by Stripe apply to deposits and are separate from our fee.
  • We may change prices with at least 30 days’ notice. Changes apply from your next billing period.
  • Fees already paid are non-refundable unless the law requires otherwise.

Deposits and payments

  • Payments are processed by Stripe. To receive deposits, a Pro must create and keep in good standing a Stripe account and accept Stripe’s terms.
  • Each Pro sets their own services, prices, deposit amounts and cancellation policy, and is responsible for stating them clearly to Clients before they book.
  • The booking contract is between the Pro and the Client. BookZefy is not a party to it and does not provide the services booked.
  • Refunds, disputes and chargebacks related to a booking are handled between the Pro and the Client under the Pro’s policy and applicable law. A Pro is responsible for chargebacks and related fees on their bookings.
  • Pros are responsible for their own taxes, licenses and legal compliance, including California rules on deposits and cancellation terms.

Messages and reminders

By using reminders, a Pro confirms that they have the right to contact their Clients about bookings. Texts and emails we send are limited to bookings the recipient made. Recipients can opt out of texts by replying STOP.

Acceptable use

You agree not to:

  • break the law or use BookZefy for illegal, fraudulent or deceptive services;
  • collect deposits for services you do not intend or are not able to provide;
  • send spam or unwanted messages;
  • interfere with the service, probe it for weaknesses or access it by unauthorized means;
  • copy, resell or reverse engineer the service except as the law allows.

Your content

You keep ownership of the content you add to BookZefy, such as your services, photos and descriptions. You give us a limited license to host, display and process it to run the service for you. You promise you have the rights to that content.

Our property

BookZefy, its software, design and branding belong to us. These terms do not give you any rights to them other than the right to use the service as described here.

Suspension and termination

You can close your account at any time. We may suspend or end access if you break these terms, create risk or legal exposure for us or others, or if required by law or by our payment partners. We will give notice where reasonably possible.

Disclaimers

The service is provided “as is” and “as available”. We do not guarantee that it will be uninterrupted or error free, or that it will eliminate no-shows or produce any particular income. Features described on our website are provided as the service becomes available.

Limitation of liability

To the fullest extent permitted by law, BookZefy is not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability for any claim relating to the service is limited to the greater of the fees you paid us in the 12 months before the claim or $100. Some places do not allow these limits, so they may not apply to you.

Governing law

These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Disputes will be brought in the state or federal courts located in California, and you agree to their jurisdiction, except where the law gives you the right to bring a claim elsewhere.

Changes to these terms

We may update these terms. We will post the new version here with a new “last updated” date and notify account holders of material changes. Continuing to use BookZefy after a change means you accept it.
